Life events, such as marital status changes, birth, death, or adoption, may necessitate changes to participant beneficiary designations. Periodic review of their designations is suggested.

If the participant is married and has designated a beneficiary other than, or in addition to, his or her spouse, the spouse's signature is required in order to complete the designation. The spousal consent form is presented at the confirmation step of the process. The spouse's consent must be witnessed by a plan representative or a Notary Public.
Because the participant's spouse would have certain rights to his or her death benefit, if the participant is married at the time of his or her death and has designated a beneficiary other than, or in addition to, his or her spouse, beneficiary designation(s) become invalid unless consented to by his or her spouse. The spouse's consent must be witnessed by a plan representative or a Notary Public.
Primary Beneficiary
If no primary beneficiary is living at the time of your death, benefits will be paid to the second class of beneficiaries.
Secondary Beneficiary
If no secondary beneficiary is living at the time of your death, benefits will be paid to the tertiary class of beneficiaries.
Tertiary Beneficiary
Information for Married Participants If the participant is married, federal law (and/or the terms of the plan) generally requires that death benefits from the plan be paid to their spouse when they die. If they designate their spouse as their sole primary beneficiary, spousal consent is not required. If they elect to have the death benefit paid, in whole or in part, to another person or organization, their spouse's consent to this election must be witnessed by a plan representative or a Notary Public. (If they are married and cannot locate their spouse, spousal consent is not required. They will, however, need to have their designation witnessed by a plan representative or a Notary Public and you may request evidence of this designation for your records.)
Trust Information If the participant's beneficiary is a trust, there shall be no obligation to inquire into the terms of the trust, and payment of the proceeds as provided in the designation will be a full discharge from all liability. If, before payment of the proceeds is made, satisfactory proof is presented that the trust has been revoked or is not in effect at their death, the proceeds shall be paid to the next class of beneficiary or to their estate if there is no such beneficiary. If the trust has been created by a will but fails to come into existence for any reason, the proceeds shall be paid to the next class of beneficiary or to their estate if there is no such beneficiary.
It is important that the participant and their spouse (when applicable) understand their rights and obligations concerning their death benefit under the plan. Any directions they may have should be directed to a plan representative.
